Your privacy is important to us
Southern Pacific Underwriting Agency Limited (“SPUA”) is committed to protecting your personal information at all times.
The purpose of this Privacy Policy is to describe how we collect, use, store and disclose your personal information to comply with our obligations under the Privacy Act 2020 (“the Act”). In this Privacy Policy, “we”, “us” and “our” means SPUA and “you” and “yours” refers to individuals we collect personal information about, to enable us to provide our services.
What is personal information
In the Act, "personal information" means information about a living and identifiable individual. We collect certain types of personal information which may include:
information required to explore options for and to provide, administer and maintain insurance. This information typically includes some or all of your:
name, address, date of birth and contact details
assets to be insured.
employment details.
certain professional qualifications (for liability insurance).
criminal history.
details of previous insurances; and
past insurance claims.
industry association memberships.
financial, billing, and invoicing information.
details about any loss or other risk event for which you are making a claim and;
any other personal information you provide us with that we may require over the course of our relationship.
How do we collect your personal information
SPUA may collect, use, retain and update personal information that you provide both:
directly, for example, by you filling out a form or sending us an email enquiring about information on our product range and
indirectly from third parties where it is unreasonable or impracticable to collect information directly from you.
For example: insurers and their agents, premium funders, credit agencies, people who are involved in a claim including witnesses and repairers, government departments and other third-party service providers like dispute resolution bodies or publicly from available sources.
Why we collect it
SPUA collects personal information for the primary purpose of arranging, administering and managing insurance products and claims including providing information to insurers. You must take reasonable care to ensure that the information you provide is accurate and complete. If you do not provide us with personal information, we may be unable to arrange or continue insurance cover including processing applications or claims.
Providing Personal Information of others
You should not provide us with the personal information for another person unless you have the express authorisation of that individual to do so. You should first:
inform the individual whose information they are providing and notify them that we will handle their information in accordance with this Privacy Policy
provide them with a copy of or refer them to this Privacy Policy; and
confirm that the individual has consented for their personal information to be provided to us.
Sharing your personal information
SPUA may disclose your personal information to others to arrange administer and manage insurance products and claims and to provide you with products and services that are relevant to you.
We may disclose:
to insurers and reinsurers and their intermediaries, claims assessors and investigators and service providers who assist us in providing insurance services, like actuaries, loss adjusters, professional advisers, credit reference bureaus, call centres, and where required to by law, government agencies.
for statutory or regulatory reporting.
for internal or external audits.
for internal training.

SPUA may use your information for purposes connected with providing, monitoring and marketing existing and future products and services to you, as well as keeping you informed of developments or opportunities in areas or activities you have previously been interested in or we believe you may be interested in.
SPUA may provide overall statistics about users, site use, demand for relevant products, services, facilities and information, traffic patterns, and related site information to reputable third parties. These statistics will not include any information that personally identifies you.
Transfer of personal information overseas
SPUA makes use of disaster recovery and other offsite data storage facilities in New Zealand and Australia. No personal information is stored in any other overseas country.
From time to time, our staff may be located overseas at the time they access your personal information to process your insurance requests. This access is only performed using a secure device and on SPUA information systems.
Some third-party service providers and the insurer referred to above may be located overseas. They may store and process personal information either on our behalf or otherwise, for one or more of the above-mentioned purposes.
Where overseas disclosure is necessary, we will take steps to ensure that the transfer of your personal information complies with the Act and your privacy is protected. We do this by ensuring he overseas party disclosure is limited to recipients is subject to privacy laws that are recognised as providing a comparable level of legal protection to the Act, and/or where we are satisfied that alternative arrangements are in place to protect your privacy rights.
If we have need to release your personal information to an overseas provider in a location without comparable privacy laws in place, we will obtain your express authorisation prior to the transfer of your personal information.
Security of personal information
SPUA maintains strict security measures to protect your personal information.
You must also take care to ensure you protect your own personal information, including using secure methods to provide it to us or receive it from us. Please notify us as soon as possible in the event of a security breach. Where required by the Act, we will notify you of any notifiable privacy breach in relation to your personal information.
Privacy policy updates
SPUA reserves the right to amend this Privacy Policy from time to time to ensure we accurately describe how we properly manage and process personal data. We recommend reviewing our Privacy Policy regularly as it may be amended or updated periodically.
How to make a complaint
If you have any questions or concerns about how we handle your personal information or want to make a complaint about a breach of this Privacy Policy please contact us by emailing solutions@spua.co.nz. Please include the details of your complaint together with any supporting evidence and information.
You also have the right to make a complaint to the Office of the Privacy Commissioner – refer to www.privacy.org.nz.
Contacting us about access to and correction of your personal information
You are entitled to request access to, and the correction of any personal information SPUA holds about you at any time. You can request a correction or request to be removed from any SPUA mailing list or similar SPUA service by emailing solutions@spua.co.nz. Your rights of removal may be subject to any additional terms that apply to the relevant list or service.
